Terms of Service

Version 2026-11-03-draft · 3 November 2026

1. Who we are

NextWebX Accounting ("the Service") is a GST billing and accounting service run by NextWebX ("NextWebX", "we", "us"). These Terms are an agreement between NextWebX and the person or business that signs up ("you"). By ticking "I agree" at sign-up, or by using the Service, you accept them.

2. The Service

The Service lets you make invoices and other documents, keep books of account, prepare GST and TDS figures and returns data, and keep your business records online. Each organisation you create has its own address (for example yourname.accounting.nextwebx.com), its own data and its own members.

The Service helps you with your accounts and compliance; it does not replace a chartered accountant or tax adviser. You remain responsible for the correctness of what you file with the GST portal, the Income Tax department or any other authority.

3. Your account

  • You must give a valid email address and keep your password secret. Turn on two-step sign-in for better protection.
  • You are responsible for everything done with your account and by the members you invite to your organisation.
  • You must be at least 18 years old and able to enter into a contract under Indian law.
  • Tell us at once at [email protected] if you think someone else has used your account.

4. Your data

Your business records (invoices, clients, suppliers, products, books, files) belong to you. For that data you are the Data Fiduciary under the Digital Personal Data Protection Act, 2023, and we process it on your behalf as your Data Processor, as set out in the Data Processing Agreement (/legal/dpa), which forms part of these Terms.

You can export all of it at any time, in every plan and state, including while your organisation is read-only or suspended (Settings > Data & privacy). You can delete your organisation at any time; it is deleted 30 days later, and you can undo the deletion until then.

GST law (section 36 of the CGST Act, 2017) requires businesses to keep books and records for 72 months. Deleting your organisation does not change that duty: export your data first.

5. Acceptable use

You must not use the Service to break the law, to issue false or fake invoices, to evade tax, to send spam, to upload malware, to try to reach another organisation's data, or to overload or probe the Service. We may suspend an organisation that does, after notice where the law and the situation allow.

6. Plans, trial and payment

A new organisation gets a free trial of the Pro plan for 14 days, without a card. Paid plans are billed in advance, monthly or yearly, through Razorpay, plus GST at the applicable rate; we issue a GST invoice for every payment. Prices are shown in Settings > Billing and may change for future periods with at least 30 days' notice.

If a payment fails, the organisation stays fully usable for 7 days, then becomes read-only, then suspended after 30 more days; after 90 days suspended and three warning emails it is scheduled for deletion (with the same 30-day undo period). You can export your data at every stage. Cancellation and refunds are covered by the Refund & Cancellation Policy (/legal/refunds).

7. Availability and support

We aim to keep the Service available at all times but do not promise uninterrupted service. Planned maintenance is announced in the app where possible. Support is by email at [email protected]. Support staff look inside your organisation only when you switch on "Allow support access" (for 72 hours), or in an emergency under a logged "break-glass" procedure that emails every owner at once.

8. Intellectual property

The Service, its software and its design belong to NextWebX or its licensors. You get a non-exclusive, non-transferable right to use the Service while your subscription or trial lasts. The desktop edition of NextWebX Accounting is licensed separately under its own licence.

9. Liability

The Service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, penalties or interest charged by an authority because of a filing you made, or loss caused by your own failure to keep your password safe or to keep copies. Our total liability for any claim is limited to the fees you paid us for the Service in the 12 months before the claim. Nothing here limits liability that cannot be limited under Indian law.

10. Ending the agreement

You may stop using the Service and delete your account or organisation at any time. We may end the agreement for a serious breach of these Terms, after notice where possible, and you will still be able to export your data for at least 30 days unless the law forbids it.

11. Changes

We may change these Terms. For changes that matter we will tell you by email or in the app at least 30 days before they apply; continuing to use the Service after that means you accept them.

12. Law and disputes

These Terms are governed by the laws of India. Disputes go first to our support team and the Grievance Officer (/legal/grievance); if not resolved, to the competent courts at Ahmedabad, Gujarat, India.
